Background Checks & Subcontractors

Many employers who hire independent subcontractors question whether they can do employee screenings on these contractors and their employees. Yes, you do have the right to conduct a pre-employment screening on a subcontractor, and this is highly encouraged. Being a subcontractor it is possible this individual works for himself or herself since they cannot get employment due to a criminal history. Also it is a good idea to look into the litigation history of a subcontractor to see what if any lawsuits have been filed against them regarding their work on other jobs. This will give you an indicator of potential problems that can arise with your job in which the contractor is hired. In many cases you also have the right to request a background check on the employees of the sub-contractor. This is especially important if the job site is based around children or others who could be in danger from a predator.
